Retail Sales Terms and Conditions

PAYMENT TERMS: An active credit card must be tendered ( Visa, MasterCard, Discover or American Express) prior to the request of any product order. On all orders, the credit card provided will be charged for the full amount of the order total immediately upon acceptance of the order. If any adjustments or changes are required to the final invoice because of changes in the order or shipping, a second processing will be created either for a credit or debit to cover the change in the final invoice total.

OUR GUARANTEE
All merchandise is guaranteed to be as described on the website, white and unpainted. Measurements are rounded and given as an approximate size only and should NOT be relied on for complete accuracy. If measurements are critical to your project, you must contact us prior to ordering to confirm the sizes. No guarantee is made that the dimensions shown will be exact to a specific fraction. Color pictures are representative of colors that may be used by the customer if the customer decides to paint the item. There are no refunds and all sales are final.

WHAT IF MY ITEM(S) ARRIVE BROKEN?
If you receive an item that was damaged during shipping, Plaque Art Creations, Inc. will send you a replacement of the same item number. In order to receive a replacement, YOU MUST contact us within 24 hours of receiving the damaged item(s) by completing our breakage claim form by clicking here AND you must include ALL the original packing material within the original box, properly tape the box closed, and give to the shipping company representative when the representative comes to pick it up for inspection.

ALL SPECIAL ORDERS ARE FINAL: A special order is defined as any order in which the quantity for any one item is greater than three or if Plaque Art Creations, Inc. requires additional processing time to process your order. Plaque Art Creations, Inc. will notify you of the lead time for your order. Upon acceptance by you, the credit card will be processed and Plaque Art Creations, Inc. will begin to process the order immediately. Once confirmed by the customer, either through verbal authorization, in writing or by electronic transmission, all special orders as submitted and processed via the web site, email, phone, fax or mail are final. Once confirmed, any errors, inaccuracies or omissions made during the placement of an order shall be the sole responsibility of the Customer. No cancellations of special orders will be accepted after receipt of confirmation, except with the express written consent of Plaque Art Creations, Inc.,

ERRORS AND RETURNS: Plaque Art Creations, Inc., retains the sole and complete discretion to authorize (or refuse to authorize) the return of any product purchased by Customer. Unless a clear error has been made by an employee of Plaque Art Creations, Inc., that is in obvious conflict with the specifications provided on the confirmed production order, no returns of merchandise will be accepted. If an error is made and acknowledged by Plaque Art Creations, Inc., in writing, then corrected replacement goods will be provided to the Customer by Plaque Art Creations, Inc., once the goods shipped in error have been returned to the authorized return address supplied.

The amount charged for the outbound shipping of the product(s) to the Customer is not refundable under any circumstances. The cost of return shipping back to the return address provided by Plaque Art Creations, Inc., (i.e. all return freight and/or delivery charges) is the responsibility of the Customer unless specifically waived IN WRITING and in advance. Further, no returns will be authorized or accepted for any products unless a request is made by the Customer within 24 hours after delivery of the goods to Customer.

SHIPPING: Plaque Art Creations, Inc., Inc will attempt in all instances to use the least expensive method of shipping product to the Customer. Plaque Art Creations, Inc., Inc is not responsible for loss or damage of products in transit. Customer will be responsible for checking shipment upon delivery for total product count and condition. Any shortage in total product count or evidence of damage to goods must be noted and reported to the carrier's office. All claims must be filed with the carrier within 24 hours from the date of loss or damage.

CHARGE-BACK FEES: Customer understands and agrees that all products and services purchased, produced and shipped are considered a final sale for which no refunds will be given or provided except as expressly provided herein. As such, Customer agrees and acknowledges that by purchasing any product or service from Plaque Art Creations, Inc., Customer shall be solely responsible for and shall bear (and/or reimburse) Plaque Art Creations, Inc., for any charge-backs or fees issued to Plaque Art Creations, Inc., from any credit card company, merchant bank or other source of payment that is issued at the request of the Customer outside of the expressly provided methods of return. Stated another way, should Customer request a refund or charge cancellation from any credit card company, merchant bank or other source of payment processing against the purchase of Plaque Art Creations, Inc., products and services, and should said card company, merchant bank or other source thereafter impose any fee or direct any charge back fee or amount to Plaque Art Creations, Inc., at the request of said Customer, Customer shall reimburse Plaque Art Creations, Inc., for the amount of said charge back fee and the initial purchase amount (the "total amount"). By purchasing any product from Plaque Art Creations, Inc., Customer expressly authorizes Plaque Art Creations, Inc., to direct the stipulated payment/charge to be made to Customer's credit card account (the same being the credit card account used in the initial purchase of said product) in the amount of said "total amount" to Plaque Art Creations, Inc., for such reimbursement, plus a twenty-five percent (25%) administrative fee to cover the costs and time involved with this process. Customer acknowledges and agrees that the policy set forth in this paragraph provides for reimbursement to Plaque Art Creations, Inc., for fees incurred, is fair and reasonable and is not a penalty clause or provision.

RETURN POLICY:
Product orders submitted and processed via the web site, email, phone, fax or mail are final.

ACKNOWLEDGEMENT AND AGREEMENT TO TERMS AND CONDITIONS: The Terms and Conditions contained herein are the exclusive terms and conditions for the sale of products from Plaque Art Creations, Inc and/or Plastercraft.com, to Customer through Plaque Art Creations, Inc., and/or Plastercraft.com. Customer agrees that the terms and conditions stated herein constitute the final, complete, exclusive expression of the agreement between Plaque Art Creations, Inc., and Customer. Customer, by submitting any order or request for an order, hereby agrees to the terms and conditions set forth herein and acknowledges that Customer has read and understands the same. In the event that any Customer instruction, request, purchase order or any other information and/or documentation submitted by Customer may contain terms and conditions in addition to or different from the terms and conditions herein, Customer agrees, by so submitting its order or by accepting products from Plaque Art Creations, Inc., that the language of the Plaque Art Creations, Inc., terms and conditions shall solely and exclusively control. Any and all new or additional terms contained on any Customer instruction, request, purchase order or any other information and/or documentation submitted by Customer is hereby expressly and completely rejected. Acceptance of Customer's order for products and services from Plaque Art Creations, Inc., and Plastercraft.com is expressly limited to these terms and conditions. By submitting an order, requesting to purchase any product or service, or taking receipt of Plaque Art Creations, Inc., products or services, Customer consents to the exclusive jurisdiction of the state and federal courts located in the State of New Jersey.


If Customer does not wish to be bound by these Terms and Conditions, Customer should not submit any order or make any type of purchase and should exit all web sites related to Plaque Art Creations, Inc. and/or Plastercraft.com, immediately!


Wholesale Sales Terms and Conditions

The following terms and conditions are not all inclusive and may be modified and amended at any time without notice.
First Time Purchasers - Please register on our website and select whether you are a Wholesale customer or a Retail Customer.  Wholesale customers will require approval before being able to login.  The approval process can take 24-48 hours.  If you are ready to place an order today, we will do our best to approve your account as soon as possible.
We must have a complete customer file prior to processing your first order. We will provide you with a New Vendor File for you to complete and submit to us. Once we have all the required documentation on file, you will be able to purchase on a wholesale basis.

Sales Tax Documentation - Before you purchase wholesale for the first time, we must have an original fully completed and signed New Jersey Sales Tax Form - regardless of where your business is located and whether you are exempt status or not. For NJ vendors, we need form ST-3 form - Resale Certificate For NON NJ vendors, we need form ST-3NR - Resale Certificate for NON-NJ Sellers If you are exempt from collecting Sales Taxes, we need form ST-4 Exempt Use Certificate

If we do not have the Sales Tax Forms on file, we will have to charge you NJ Sales Taxes. This amount cannot be waived and cannot be refunded if you bring the papers at a later date.

If your information changes at any time, you must submit an updated form for our files. Resale Certificate - Please send us copy of your resale tax certificate for our files.

Lead Times - For regular orders, we ask for at least 5 business days to process your orders and will notify you if your order is completed sooner. If we need additional time to process your order, we will notify you when the order is placed. Additional time is typically only needed if you are placing an order for a large quantity of one item - for example 100 of one item number. Most of our wholesale orders are processed within 5 business days.

Rush Orders - Rush orders may need to be charged an additional 25% rush processing fee for same day processing if necessary. Please let us know what items you need before placing your order so we can let you know if same day processing is available.

Minimum Orders - Our minimum purchase for shipping on a pallet at wholesale prices is $300. Orders below this amount may need to be shipped via ground and will require additional packing fees.

Out of Stock Items - If an item is out of stock, we will do everything possible to include it in your order. If we cannot fulfill the entire quantity of the items, we will reduce the quantity and adjust your invoice accordingly. If there is a specific item that you absolutely need to have included, please let us know at the time the order is placed and we will make sure the item is included in your order (additional time may be needed).

Duplicate Items - If you submit an order with duplicate items, we may process the order as is. We will try our best to remove the line item with the lesser quantity without notification to the customer, but this is not guaranteed.

Customer pickup times Customers that are picking up their orders can do so during regular warehouse hours ONLY. Warehouse pickup hours are Monday - Friday 9:00am - 2:00pm. Please let us know in advance so we can make arrangements to have employees available to load your vehicle. Please note that if you arrive during lunchtime there may be a delay in loading your vehicle. There is NO PICKUP ON SATURDAYS.  If you are scheduled to pick up your order and need to reschedule, please contact us immediately.

Returns - All sales are Final - Absolutely no buybacks or returns. No returns. No Exchanges. No exceptions.

Packaging - In order to keep our prices as low as possible, all wholesale products are packaged in bulk in mixed boxes.  Boxes are not labeled with quantities or inner contents.  If you require your orders to be packaged with individual boxes per item and labeling on the outside of the box, we will add a special packaging fee to your order.  The custom packaging option is priced at 25% of the order total to cover additional labor and packaging costs.

Shipping - If your merchandise is being shipped via common carrier or courier service, delivery and/or freight fees must be paid directly to freight company. If there are additional charges invoiced to us afterwards by freight company including but not limited to lift gate or inside delivery services that were used at time of delivery, customer will immediately pay fees directly to freight company.

Because of the high cost of packaging materials and labor involved to ship merchandise via UPS, Fedex or USPS, additional packaging fees may apply in addition to actual shipping fees.

Freight on Board All merchandise is FOB our factory in Kearny, NJ.

Damaged Goods - Any damages that occur during shipping must be reported immediately to the freight company and customer must file a claim with the freight company for reimbursement. Under no circumstances is Plaque Art Creations, Inc, responsible for damage during shipping.

Liftgate Fees by Trucking Companies

 A liftgate is the portion of the vehicle making the delivery that can be raised or lowered in order to facilitate the delivery of your merchandise. It is the customers responsibility to determine whether they require a liftgate and if the truck driver determines that a liftgate is needed, any and all additional liftgate fees will be paid for by customer upon notification of a revised invoice. It is the customers responsibility to inquire what the liftgate fee will be for their specific delivery. If your order is shipping via truck on a pallet, please let us know if you will require liftgate services so we can obtain a proper quote for you.

Inside Delivery Fees by Trucking Companies

If customer requires inside delivery, the freight company will send an invoice including the inside delivery fees. It is the customers responsibility to pay the fees upon notification of a revised invoice.

Prices - All merchandise prices are subject to change without notice. Any errors or omissions will be adjusted on the invoice.

Payment Terms - All merchandise must be paid for in full prior to leaving our factory. A credit card must be on file when the order is placed to begin processing.

Payment on file A signed original credit card authorization form must be on file.

Returned Checks - All bank fees and costs associated with a check returned for insufficient funds or for closed accounts or any reason deemed by the banking institution will be the responsibility of the customer and must be paid for by money order or cashier’s check.

Personal Checks - NO personal checks are accepted.

Credit Card Fees - Plaque Art Creations, Inc. reserves the right to invoice for credit card fees for customers using credit or debit cards for payment up to any applicable legal limit.

Product Images Customer may NOT use images either from catalog or from Plaque Art Creation’s websites (including, but not limited to plastercraft.com) without the express written permission of Plaque Art Creations, Inc.

Third Party Websites
Customer may not sell merchandise purchased from Plaque Art Creations, Inc. on Ebay, Amazon or any other website without the express written permission of Plaque Art Creations, Inc. Merchandise is sold only on a wholesale basis to verifiable retail brick and mortar storefronts that specialize in plastercraft products.
